KIRSTEN BERTRAM AGENT COMPETITION WITH BUMP DEE WHY JUNE/JULY 2023 COMP – TERMS AND CONDITIONS
- Promotion Overview
1.1. This Instagram competition (the “Competition”) is a partnership between @kirstenbertram.upstate (“Promoter”) and BUMP Dee Why.
1.2. The Competition will run from 30th June to 30th July (“Competition Period”).
1.3. By entering the Competition, participants have a chance to win a 3-month membership to BUMP Dee Why, valued at approximately $750 (“Prize”). - How to Enter
2.1. To enter the Competition, participants must follow @kirstenbertram.upstate on Instagram, like the promotion post, and tag their friends in the comments.
2.2. Participants can submit unlimited entries during the Competition Period. - Eligibility
3.1. The Competition is open to individuals who are at least 18 years old or have obtained consent from a parent or legal guardian.
3.2. Participants must have a valid Instagram account. - Winner Selection
4.1. The winner will be randomly selected from all eligible entries received during the Competition Period.
4.2. The draw will take place within seven days after the Competition ends.
4.3. The winner will be notified via Instagram direct message and announced on @kirstenbertram.upstate’s Instagram account. - Prize
5.1. The winner will receive a 3-month membership to BUMP Dee Why, valued at approximately $750.
5.2. The winner must not be a current member of the club. The membership begins on the winner’s first visit to the club.
5.3. The Prize is non-exchangeable or refundable for cash. - Verification and Claiming the Prize
6.1. The selected winner must respond to the winner notification within five business days.
6.2. The winner must provide necessary verification details (such as name, age, and contact information) to claim the Prize.
6.3. Failure to respond within the specified timeframe may result in disqualification, and another winner will be selected. - Publicity
7.1. By entering the Competition, participants agree that if they win, their name and Instagram handle may be announced on @kirstenbertram.upstate’s Instagram account and other promotional channels associated with the Competition. - Promotion Restrictions
8.1. Incomplete, illegible, or indecipherable entries may be deemed void.
8.2. Entries deemed offensive, inappropriate, or violating any third-party rights will be disqualified.
8.3. Participants must comply with all Instagram policies and guidelines. - Privacy
9.1. Personal information collected during the Competition will be used solely for the purpose of administering the promotion and contacting the winner.
9.2. Participants’ personal information will not be shared with third parties unless required by law. - Liability
10.1. Participants release @kirstenbertram.upstate, BUMP Dee Why, Instagram, and associated sponsors, partners, or affiliates from any liability arising from their participation in the Competition or acceptance, possession, use, or misuse of the Prize. - Governing Law and Jurisdiction
11.1. These Terms and Conditions are governed by the laws of [Australia].
11.2. Any disputes arising from or in connection with the Competition shall be subject to the exclusive jurisdiction of the courts in [Australia]. - Amendments and Termination

16.1. These Terms and Conditions constitute the entire agreement between the participants and the Promoter regarding the Competition and supersedes any prior agreements or understandings, whether written or oral. - Severability
17.1. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in effect. - Promotion Acknowledgment

CHRISTMAS GINGERBREAD DEC 2022 COMP – TERMS AND CONDITIONS
1- The promoter is: Upstate Group PTY LTD whose registered office is at Level 1, Suite 15, 888 Pittwater Road, Dee Why, NSW, 2099.
2- The competition is open to residents of Australia, New South Wale one. Aged 16+ years or over except employees of Upstate Group and their close relatives and anyone otherwise connected with the organisation or judging of the competition.
3- There is no entry fee and no purchase necessary to enter this competition.
4- By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
5- Route to entry for the competition and details of how to enter are found on our Instagram page @my_upstate
6- Only one entry will be accepted per person.
7- Closing date for entry will be 22/12/2022 at 11:59pm AEST. After this date the no further entries to the competition will be permitted.
8- No responsibility can be accepted for entries not received for whatever reason.
9- The rules of the competition and how to enter are as follows:
10- The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
11- The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
12- The prize is as follows: The prize is a $250.00 (two hundred and fifty dollars) eftpos gift card.
The prize is as stated and no cash or other alternatives will be offered. The prizes are not transferable.
13- Winners will be chosen by the Upstate marketing team from all entries received. [by an independent adjudicator or panel of judges appointed by the Promoter].
14- The winner will be notified Instagram DM on the 23/12/2022 and shared on the platform thereafter. If the winner cannot be contacted or do not claim the prize within 1 day of the notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
15- The promoter will notify the winner when and where the prize can be collected / is delivered.
16- The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
17- By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
18- The winner agrees to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner or any other entrants will be used solely in accordance with current Aus data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
19- Entry into the competition will be deemed as acceptance of these terms and conditions.
20- This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network. You are providing your information to Upstate Group and not to any other party.
